Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Nomp mobile application or website (collectively, the “Service”) operated by Nomp Inc. (“Nomp”, “we”, “our”, “us”).
By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
Nomp is open to users aged 13 and above. By creating an account you confirm that you meet this minimum age and that the information you provide is accurate and current. We do not knowingly collect personal information from anyone under 13. If you are under the age of majority in your country (typically 18) you may use Nomp's non-financial features only — see Section 3 below.
If you are aged 13–17 and your parent or guardian has questions, they may reach us at support@mynomp.com.
2. Your Account
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@mynomp.com if you suspect unauthorised access.
- You may not create accounts for others without their express consent.
3. Wallet and Real-Money Pledges (18+ only)
Nomp's Wallet and real-money pledge features are only available to users aged 18 and older. Users aged 13–17 can still use the rest of the app — sessions, buddies, streaks, and non-cash rewards (Coffee, Lunch, Kudos, or a Custom reward you and your buddy agree on). These non-cash rewards are tracked as social commitments inside the app and never involve money.
If you are 18 or older and choose to use real-money pledges:
- The Nomp Wallet allows you to deposit funds (via Stripe) to back accountability pledges.
- Pledge amounts are reserved from your wallet balance when a session is created.
- If you complete a session successfully, the pledged amount is returned to your wallet in full.
- If you fail to complete a session, the pledged amount is forfeited. Forfeited pledges flow to one of two destinations you pre-select in Settings: a curated charity from our approved list, or Nomp's operating fund. Forfeited pledges are never transferred to another user as cash. Buddies who succeed receive recognition (badges, credits, leaderboard standing) inside the app, not money.
- All payments are processed by Stripe. Nomp does not store card details.
- Wallet balances are non-transferable and have no cash value except as described in the withdrawal policy within the app. Withdrawals over US$250 lifetime cumulative require identity verification through Stripe Identity.
- We reserve the right to freeze wallets involved in fraudulent or disputed transactions.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Harass, threaten, or abuse other users.
- Attempt to manipulate pledges, streaks, or buddy-approval systems fraudulently.
- Reverse-engineer, decompile, or otherwise attempt to extract the Service's source code.
- Use automated bots or scripts to interact with the Service.
- Upload or transmit malicious code, spam, or misleading content.
5. Subscriptions
- Nomp offers a free tier and a Pro subscription (monthly, quarterly, or annual).
- Subscriptions are billed via the Apple App Store or through Stripe for web purchases.
- The 7-day free trial automatically converts to a paid subscription unless cancelled before the trial ends.
- Cancellations take effect at the end of the current billing period. No partial refunds are issued.
- We reserve the right to change pricing with at least 30 days' notice.
6. Intellectual Property
All content, design, trademarks, and software in the Service are owned by Nomp Inc. or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes only.
By submitting content to the Service (e.g., profile information, session names), you grant Nomp a worldwide, royalty-free licence to use, store, and display that content solely to operate the Service.
7. Termination
We may suspend or terminate your account at any time if you violate these Terms or if we determine your use poses a risk to other users or the integrity of the Service. You may delete your account at any time from the app settings.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. NOMP DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS. USE OF THE SERVICE IS AT YOUR OWN RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOMP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO NOMP IN THE 12 MONTHS BEFORE THE CLAIM OR (B) $100.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute shall be resolved by binding arbitration under the AAA Consumer Arbitration Rules, except that either party may seek injunctive relief in court.
11. Changes to These Terms
We may update these Terms periodically. Material changes will be communicated via in-app notification or email at least 14 days before they take effect. Your continued use of the Service after that date constitutes your acceptance of the revised Terms.
